MNF LEGAL BOARD CANNOT JUST WATCH A CHIEF MINISTER WHO DELIBERATELY VIOLATES MCC AND OTHER LAWS
1. MNF Party expresses its deep concern and strong condemnation over the hate speech delivered by the Hon’ble Chief Minister Mr. Lalduhoma on 01/11/2025 during his campaign for the ZPM Party at Silsury. The Chief Minister has deliberately violated the provisions of MCC and other laws by making provocative and decisive statements aimed at igniting tension between different communities living peacefully in Mizoram. The MNF Legal Board cannot remained a silent spectator to such highly objectionable an unethical conduct committed solely for electoral gain.
The Chief Minister begun his speech by saying “Our past leaders have sown the seed of hatred between Mizos and Chakmas. The leader in the past used to teach us how to hate Chakma community.” He further made other shocking remarks including the purported speech of former chief minister Zoramthanga, in an apparent attempt to provoke members of the Chakma community. Making such a provocative speech and accusing former leaders of his own Mizo community against the Chakma community is highly unethical and condemnable, especially coming from a sitting Chief Minister who is expected to uphold the law and maintain communal harmony. Such conduct clearly violates the MCC issued by The Election Commission of India particularly:
General Conduct- 1. No party or candidate shall include in any activity which may aggravate existing differences or create mutual hatred or cause tension between different castes and communities, religious or linguistic.
Further, the provision of section 123 (3-A) of and section 125 of the Representation of People Act, 1951 have also been clearly violated by the speech of the Chief Minister which has clearly provided that any person who in connection with an election under this Act promotes or attempts to promote on grounds of religion, race, caste, community and language, feelings of enmity or hatred, between different classes of the citizens of India shall be punishable with imprisonment for a term which may extend to 3 years or with fine or with both. This is the first time; Mizoram has a Chief Minister who openly disregards the law while holding public office.
2. In his speech, the Chief Minister further threatened voters with denial of government benefits and offering inducements to secure votes for his party. He claimed that Silsury Road would be constructed with Rs.100.40 crore. He further announced promises of financial grants, road construction, implementation of Border Trades, giving of Chief Minister’s Special Package, Housing assistance for the poor etc. Such announcements are direct violations of Clause VII 6 (a) & (c) of the MCC guidelines issued by the Election Commission of India.
Model Code of Conduct Para VII 6(a) & (c) are as follows:
VII. Party in Power
The party in power whether at the Centre or in the State or States concerned, shall ensure that no cause is given for any complaint that it has used its official position for the purposes of its election campaign and in particular –
From the time elections are announced by Commission, Ministers and other authorities shall not –
(a) announce any financial grants in any form or promises thereof; or
(c) make any promise of construction of roads, provision of drinking water facilities etc.;
Since the Chief Minister has acted as if he is above the law, it is unfortunate that MNF Legal Board has to submit a formal complaint today, 6.11.2025, to the office of Jt. Chief Electoral Officer, Aizawl requesting appropriate action under the Representation of the People Act, 1951 and the Model Code of Conduct.
